            The Town of Charlton will be accepting sealed bids for Mold Remediation for the purpose of the New Town Hall Project, 758 Charlton Rd, Charlton, NY 12019. 

Prime bids will be accepted at the Town Clerk’s Office, 784 Charlton Road, Charlton, New York 12019 until 2:00 P.M. on Thursday, October 26, 2007 and at that time publicly opened.  Plans and specifications may be obtained at the above address.

All bidders are required to examine work conditions prior to submission of a bid.  The Owner reserves the right to waive irregularities in bids and in bidding and to reject any or all of the proposals.

             A RESOLUTION ESTABLISHING A HALLOWEEN NIGHT CURFEW

                                                                             

 

            WHEREAS, the Town Board has determined that it is in the best interest of the residents of the Town of Charlton to establish a curfew for the evening of Halloween, in order to assure the health and safety of its residents.

 

            NOW BE IT RESOLVED, that the Town Board hereby determines that a curfew shall be in effect commencing at 9:00 p.m. on Wednesday, October 31, 2007 and continue until 7:00 a.m. on Thursday, November 1, 2007, during which curfew period no child under the age of 18 years shall be anywhere other than the property or residential dwelling of such child’s parents, unless so accompanied by the child’s parent or guardian.

As of March 10, 2003, the Town of Charlton has been required to obtain a permit and participate in a New York State Department of Environmental Conservation (DEC) mandated program for Municipal Separate Storm Sewer Systems (MS4).  The purpose of this program is to control the inflow of pollutants into the town’s storm sewers and drainage ditches.  Products such as oil, antifreeze, litter, animal wastes, fertilizer, pesticides and sediment from erosion can be washed into the storm drain system during rain storms or by melting snow.  Evenutally this untreated storm water flows into our streams, and lakes and can impact water quality.

 

The MS4 program contains six techniques designed to reduce these “nonpoint sources” of water pollution.  Two of these measures include Illicit Discharge Detection & Elimination and Site Stormwater Runoff Control.  Charlton’s permit requires the passage of two local ordinances establishing an enforcement mechanism for each of these measures.  The DEC has written models of each law for communities to adopt into their own code. The Town of Charlton is currently reviewing these models and must implement the final versions by the end of the current permit year.

 

The Illicit Discharge Detection & Elimination law is concerned with preventing the introduction of pollutants into storm drains and drainage ditches.  The broad language of the ordinance includes activities of gross abandon such as dumping harmful items into storm drains as well as less deliberate actions such as seepage from failed septic systems.  Discharge of clean groundwater through cellar drains or sump pumps is permitted provided that no other items are combined with the clean water.  The law also creates enforcement powers for Town Officials and penalties for violations.

 

The stormwater runoff law applies to construction activities that result in ground disturbance typically greater than one acre in size.  Smaller projects such as home construction or land clearing may also be subject to regulation under certain circumstances.   Removal of vegetation and the alteration of the ground surface from its natural condition can lead to erosion from both wind and rain.  Sediment from this erosion eventually is introduced into water bodies causing turbidity and the possible destruction of stream habitats and wildlife.  The storm runoff law requires individuals conducting construction activity to implement erosion control measures and prepare stormwater pollution prevention plans.  The law also provides for the oversight of construction activities by Town Officials to ensure that these preventative measures are adequately installed and maintained.

 

As part of the legislative process, the Town Board will conduct a public hearing on the proposed ordinances.  The draft text of each law is also posted on the town website. (www.townofcharlton.org)   Residents interested in understanding how these laws may impact their activities are encouraged to view the proposed laws and attend the public hearings.  A notice of the hearing dates will be advertised as well as posted in the Calendar of Meetings section of the town website.

                           A RESOLUTION AUTHORIZING THE TOWN HIGHWAY

                         SUPERINTENDENT TO PREPARE BID SPECIFICATIONS

                                   AND ADVERTISE FOR BIDS TO PROVIDE THE

                                              TOWN WITH ICE CONTROL SAND

                                                                             

            WHEREAS, in order to meet its obligations to the residents of the Town of Charlton, the Town Highway Department needs to have available screened sand for the purpose of ice control, and

 

            WHEREAS, the Town Highway Superintendent has the necessary expertise to prepare bid specifications in order to assure that the quantity and quality of ice control sand will be available to the Town Highway Department during the period October 1, 2007 - May 1, 2008 as may be needed to meet Town Highway Department obligations.

 

            NOW BE IT RESOLVED, that the Town Highway Superintendent is hereby authorized to prepare bid specifications necessary to obtain ice control sand in sufficient quantity and of sufficient quality to meet the needs of the Town Highway Department for the period October 1, 2007 - May 1, 2008, and

 

            BE IT FURTHER RESOLVED, that the Town Highway Superintendent is hereby authorized to advertise for sealed bids for such ice control sand, which bids shall be received by no later than 1:00 p.m. on Tuesday, October 9, 2007 and that such bids will be opened at 7:30 p.m. during the regularly scheduled meeting of the Town Board held on October 9, 2007.
